A game-changing witness has emerged in the case of Daniel Penny. Mr. Penny, known as the Marine Subway Hero, is currently facing manslaughter charges after restraining Jordan Neely, a violent homeless man who passed away in the process. According to this bombshell witness, on that fateful day aboard a New York City subway train, Mr. Neely, a career criminal, made threats to kill people before Mr. Penny intervened to subdue him. The situation was so incredibly frightening and intense that after the incident concluded with Mr. Neely’s demise, the witness approached Mr. Penny and thanked him for his actions.

The New York Post:

A straphanger who was on the subway when former Marine Daniel Penny placed Jordan Neely in a fatal chokehold said Thursday she’s “praying” for Penny after it was revealed the 24-year-old would face charges tied to the high-profile case.

“I hope he has a great lawyer, and I’m praying for him,” the 66-year-old woman, who did not want to be identified, told The Post Thursday night. “And I pray that he gets treated fairly, I really do. Because after all of this ensued, I went back and made sure that I said ‘Thank you’ to him.”

This next part is the game-changer in Mr. Penny’s defense. In a fair and just world, Mr. Penny would never have been charged, but these days, sanity and justice seem to be lacking. We’re under the control of an extreme liberal mob who have turned thugs and bad guys into heroes and victims and made good guys like Mr. Penny, the villains. NY Post (emphasis ours):

The subway rider said Neely, who had a history of mental illness, was threatening passengers after he hopped on an F train in Manhattan.

“He said, ‘I don’t care. I’ll take a bullet, I’ll go to jail’ because he would kill people on the train,” the woman said of Neely. “He said, ‘I would kill a motherf—er. I don’t care. I’ll take a bullet. I’ll go to jail.’”

The retiree said Penny did not initially engage with Neely during the wild rant until things got out of hand and he felt the urge to step in.

Mr. Neely’s mental health and violent tendencies were so serious that he was previously placed on a “Top 50” list of the most at risk homeless people in the city. Local outreach workers believed he was a potential threat to himself and others. Unfortunately, local officials failed in their jobs and lost track of him. As a result, Daniel Penny was forced to step in and do the cities job, and now shockingly, he faces the possibility of up to 15 years in prison for his heroic actions.

Furthermore, the exculpatory witness is testifying that Mr. Penny did everything he could to ignore the psychopath:

This gentleman, Mr. Penny, did not stand up,” the rider said. “Did not engage with the gentleman. He said not a word. It was all Mr. Neely that was … threatening the passengers. If he did not get what he wants.”

Neely had a criminal history with more than 40 arrests, law enforcement sources previously told The Post.

“‘Gonna go to jail for life’? What? What penalties involve going to jail for life?” she wondered. “Could you tell me? Yeah, it’s not kicking somebody in the shin, or punching somebody in the face.”

Even more disheartening, the woman testified that she provided a statement to the NYPD, and they still ended up charging Mr. Penny:

The woman said she and another rider gave their account of the incident to authorities at the precinct because Penny asked them to. Other subway riders took videos of the encounter between Penny and Neely, she said.

“So I believe that those videos are going to come forward, maybe people will do it anonymously,” she said.

With this witness testimony in hand, it is unconscionable that Fat Alvin Bragg moved this sham of a case forward to a grand jury instead of closing it altogether.

Mr. Penny’s legal defense fund has racked up an impressive sum of nearly 2.5 million dollars. That is a testament to the American people standing by him as he takes on the Soros-backed left-wing machine that’s turned our justice system into a weapon against anyone who doesn’t toe the progressive line.

It’s downright disheartening to see our country demonize and punish a young guy who’s just trying help innocent people. We’ve got our priorities all messed up; treating the wrong folks like criminals while the actual criminals get applause. America is circiling the drain.
